1. Acceptance of Terms

By accessing or using the AFE Leaks service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Modifications to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes indicates your acceptance of the new Terms.

3. Description of the Service

AFE Leaks provides an interactive platform for oil and gas well cost benchmarking, production data analysis, and independent research covering 99,000+ wells across the Lower 48. The Service includes:

  • Well Cost Benchmarking - Compare AFE and actual well costs across operators, basins, and cost components using real-world data.
  • Interactive Data Tools - Access well-level production data, cost breakdowns, vendor analysis, and template well cost estimation.
  • Research Portal - Comprehensive analysis reports on upstream economics, operator strategies, and market trends.
  • API Access - Authorized subscribers under applicable API plans may integrate our data directly into their internal systems via RESTful APIs and OData endpoints, subject to plan limits and usage restrictions.
  • Secure Platform - The Service is hosted on Google Cloud Platform via Firebase and is available at https://afeleaks.com.

4. Account Registration and Single-User License

To use the Service, you must register and create an account. You agree to provide accurate and complete information during registration and to keep this information updated.

IMPORTANT - SINGLE-USER LICENSE RESTRICTION:

  • Basic and Premium subscriptions are SINGLE-USER licenses only. Each subscription grants access to one (1) individual user exclusively.
  • Sharing login credentials is strictly prohibited and constitutes a material breach of this agreement.
  • Account sharing, password sharing, or providing access to unauthorized users may result in immediate termination of your subscription without refund.
  • Legal Action: Violation of these single-user license terms may subject you to legal action for breach of contract, copyright infringement, and unauthorized access to proprietary data.
  • Corporate/Multi-User Access: If you need access for multiple users or team members, you must purchase a Corporate license. Contact bd@afeleaks.com for corporate pricing.

You are solely responsible for safeguarding your password and maintaining the confidentiality of your account credentials.

5. User Responsibilities & Data Restrictions

You agree not to misuse the Service or assist any third party in doing so. Prohibited uses include, but are not limited to:

  • Sharing account access with unauthorized users or providing login credentials to third parties.
  • Bulk downloading or scraping data for redistribution, resale, or mass replication without explicit written permission.
  • Unauthorized automated data extraction using bots, scripts, crawlers, or other automated tools to systematically download our proprietary data outside of AFE Leaks-authorized API or OData access.
  • Circumventing subscription fees by signing up, downloading data, and immediately canceling to avoid ongoing payments.
  • Circumventing technical controls such as quotas, usage caps, rate limits, endpoint restrictions, seat limits, authentication requirements, or other safeguards we apply to the Service.
  • Reverse engineering our data methodologies, algorithms, or proprietary analysis techniques.
  • Violating any local, state, national, or international law.
  • Transmitting viruses, malware, or any other destructive code.
  • Attempting unauthorized access to our systems, databases, or other users' accounts.

Monitoring and Enforcement: We actively monitor usage patterns, login sessions, and data access. Accounts violating these terms will be immediately terminated, and we reserve the right to pursue legal remedies including but not limited to damages, injunctive relief, and attorney fees.

6. API Access Terms

Use of the AFE Leaks API and OData endpoints is permitted only under a valid API subscription or other written license from AFE Leaks. API access is licensed, not sold, and is subject to the following additional terms:

  • Internal business use only. API data may be used solely for your internal business, research, diligence, underwriting, modeling, and analysis purposes.
  • No credential sharing. API keys, tokens, and other access credentials are confidential and may not be shared, transferred, sublicensed, or embedded in public repositories, public applications, or public client-side code.
  • No redistribution or resale. You may not redistribute, republish, resell, sublicense, syndicate, or otherwise make API data available to any third party except as expressly authorized in writing by AFE Leaks.
  • No service bureau or external product use. You may not use the API or API data to operate a service bureau, customer-facing product, external dashboard, external data feed, or other offering for third parties without explicit written permission.
  • No competitive dataset creation. You may not use the API or API data to create, train, enrich, validate, or maintain a competing database, benchmark product, commercial dataset, or machine-learning model intended for external use or commercialization.
  • Usage limits apply. API access may be subject to plan-specific quotas, usage caps, seat limits, rate limits, endpoint restrictions, and technical controls, all of which may be changed, enforced, suspended, or expanded by AFE Leaks at any time.
  • Caching and retention limits. You may retain API outputs only as reasonably necessary for your permitted internal use, unless a longer retention right is expressly granted in your order form or other written agreement.
  • Termination. Upon termination or expiration of your API access, you must stop using the API and, upon request, delete API credentials and API-derived datasets retained outside the Service, except where retention is required by law.

7. Subscription Plans and Pricing

AFE Leaks offers subscription plans for individual, team, and API users. Available plans, features, quotas, and pricing may change over time. Current offerings may include Basic, Premium, Starter API, Professional API, Corporate, and Enterprise packages.

  • Basic Plan ($10/month or $100/year) - Access to benchmarking tools and research reports. Single-user license only.
  • Premium Plan ($100/month or $1,000/year) - Full access to all data tools, detailed cost breakdowns, and advanced analytics. Single-user license only.
  • API Plans - API plans may include plan-specific quotas, rate limits, seat limits, and endpoint restrictions as described on the applicable pricing page, order form, or agreement.
  • Corporate / Enterprise Access (Contact for pricing) - Multi-user licenses, API access, and enterprise features for teams and organizations.

8. Payment Terms and Refund Policy

  • Payment Processing - All payments are processed securely through Stripe. Subscriptions automatically renew unless canceled.
  • Refunds - All sales are final. Refunds are only provided in cases of technical errors or billing mistakes. Contact bd@afeleaks.com within 7 days of the transaction.
  • Pricing Changes - We reserve the right to change pricing with 30 days advance notice to existing subscribers.
  • Subscription Abuse - Accounts that repeatedly subscribe and cancel to avoid ongoing fees will be permanently banned from the Service.

9. Cancellation and Termination

  • User-Initiated Cancellation - You may cancel your account at any time through your account settings or by contacting support. Access to premium content will be revoked at the end of your billing cycle.
  • Immediate Termination - We reserve the right to immediately suspend or terminate your account without notice for violations including but not limited to: account sharing, credential sharing, data scraping, or any breach of the single-user license terms.
  • No Refund Upon Termination - Accounts terminated for violations of these Terms are not eligible for refunds of any kind.
  • Post-Termination - Upon termination, you must immediately cease all use of the Service and destroy any downloaded data or materials.

10. Intellectual Property and Data Protection

All content on the Service, including well cost data, production data, research reports, analysis methodologies, and software, is proprietary to AFE Leaks Research and Consulting LLC and is protected by copyright, trademark, trade secret, and other intellectual property laws.

Data Usage Rights: Your subscription grants you a limited, non-exclusive, non-transferable, revocable right to access and use our data solely for your internal business purposes and only within the scope of your applicable subscription or written agreement. You may not redistribute, resell, share, sublicense, or commercially exploit our proprietary data or API outputs without explicit written permission.

11. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

12. Limitation of Liability

To the fullest extent permitted by law, AFE Leaks Research and Consulting, LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

13. Governing Law and Legal Jurisdiction

These Terms are governed by the laws of the United States and the state of Texas, without regard to its conflict of laws principles. Any legal action or proceeding arising from or related to these Terms or your use of the Service shall be brought exclusively in the courts of Harris County, Texas.

Legal Enforcement: AFE Leaks Research and Consulting, LLC reserves the right to pursue all available legal remedies against users who violate these Terms, including but not limited to monetary damages, injunctive relief, and recovery of attorney fees and costs.

14. Dispute Resolution

Any disputes arising out of these Terms or the use of the Service shall be resolved through binding arbitration in Harris County, Texas, as per the rules of the American Arbitration Association.
